H-3

H-3 (Nonimmigrant Trainee Visa)

An H-3 visa is used by foreign nationals to participate in a training program that will prepare them for careers abroad. The training provided must not be available in the foreign national's home country, and the foreign national must not already have the training.

The primary limitation on the H-3 visa is that the foreign national cannot be engaged in productive employment during the training program. Therefore, a petitioner must be able to show how expending the time and money training the foreign national for a career abroad, will benefit the petitioner.

The spouse and children of an H-3 visa holder can obtain H-4 visas. H-4 visas do not authorize employment.
